Sometimes litigation is the only way to resolve a dispute. But there are downsides to lawsuits: they can be expensive, the process is usually slow, and the results are always uncertain. Also, trials are usually open to the public, meaning the details of the lawsuit can be accessed by anyone.
Thankfully, most disputes can be resolved by mutual agreement of the parties before a trial and sometimes even before a lawsuit is filed. By using Alternative Dispute Resolution (“ADR”) procedures, the parties can agree on the resolution of a dispute, eliminating the cost, delay and uncertainty of a trial. Also, ADR can provide the parties with a level of confidentiality, allowing the parties to limit information available to the public when discretion is important.
Alternative Dispute Resolution works because it helps the parties focus on and understand the issues that may be preventing a dispute from being resolved economically, timely and fairly.
